What is the role of the probation officer?
The probation officer is not the court and does not replace the police. His job is to accompany the convicted person, ensure compliance with court requirements and report to the court on the progress of the probation.
If a directive for abstinence is included in the decision, the probation service can coordinate appointments, request evidence or advise at which office a screening should be submitted. However, without a legal basis, it cannot create a completely new testing requirement on its own. How do drug tests work for probation conditions?
If you are on probation, a quick test you bought yourself is usually not enough. The court needs verifiable, documented proof. Therefore, usable abstinence checks are usually carried out by medical authorities, health authorities, forensic medicine institutes, forensic outpatient clinics, accredited laboratories or other commissioned providers.
The UKE Institute for Forensic Medicine expressly describes abstinence checks as a service for the police, judiciary and authorities. Such bodies can organize identity, sample delivery, transport, analysis and result documentation in such a way that the evidence is legally more reliable than a private rapid test.
Urine screening for probation
Urine screening is the most common form of short-term abstinence control. It checks whether certain substances or degradation products can be detected in the urine. Cannabinoids, cocaine metabolites, amphetamines, opiates, benzodiazepines and other substance groups are often tested.
In screenings that can be used in court, the sample is often submitted under visual inspection or under specially documented conditions. Hair analysis as long-term evidence
A hair analysis can show consumption over a longer period of time. It is more suitable for retrospective control and less for the question of whether someone consumed yesterday or the day before yesterday. Head hair is often preferred because it is easier to classify in time than body hair.
Hair analysis is more expensive than urine screening and can be more difficult to evaluate due to cosmetic treatments, hair length, contamination or sample quality. Short-term invitations are common
Many programs work with short-term invitations. Those affected must then appear within a short period of time to submit samples. The idea is not to hide consumption through long lead times. Anyone who is ill, cannot be reached or cannot appear for reasons beyond their control should react immediately and provide evidence.
Who pays for drug tests on probation?
The question of costs is one of the most common points of contention. In practice, it is often expected that convicts initially pay for drug screenings themselves. This can be a significant burden during multiple urine tests or hair analyses.
But it’s not completely limitless. Section 56c StGB contains the idea of reasonableness: Instructions must not place unreasonable demands on one’s lifestyle. It is therefore discussed in case law that if the financial capacity is lacking, a subsidiary cost assumption by the state treasury can be considered. What to do if you can’t pay for the tests?
It’s important not to just stay away. Anyone who cannot bear the costs should respond immediately in writing and provide evidence of their financial situation. It makes sense to provide proof of income, citizen’s allowance or other benefits, rent, maintenance obligations, debts and ongoing charges.
Depending on the case, several solutions can be considered: assumption of costs, adjustment of the instructions, lower test frequency, payment in installments or another suitable testing center. Which option is realistic depends on the decision, the court and the economic circumstances.
What happens if you test positive for a drug while on probation?
A positive drug test is serious, but does not automatically result in probation revocation. The court examines whether there has been a violation of instructions, how serious it is and whether the original positive probation prognosis is still valid.
According to § 56f StGB, the suspension of sentence can be revoked if someone commits a crime during the probation period or grossly or persistently violates instructions and thereby gives rise to concerns that they will commit crimes again. A single relapse is therefore assessed differently than repeated use, deception or breaking off all contact with the probation service.
Possible reactions of the court
Before revocation, milder reactions may be considered. These include, for example:

Can you refuse a drug test while on probation?
No one can practically be forced to pass urine voluntarily. Legally, however, a refusal can have significant consequences if there is an effective court order. Then the refusal can be assessed as a violation of instructions.
This particularly applies to repeated absences, blanket rejection, unavailability or lack of justification. In some cases, a refusal to appear in court is even more stressful than an open relapse because it signals a lack of cooperation. Manipulation is not a solution
Attempts at manipulation are particularly risky when it comes to probation conditions. They can destroy trust and be seen as a problem in their own right. What applies to addiction, relapse and therapy?
If you have an existing addiction, the situation is particularly sensitive. An abstinence instruction can in principle be permissible, but must remain reasonable. This is also shown by a decision by the Nuremberg-Fürth Regional Court of October 18, 2023: There, an abstinence order for a drug-addicted convict was assessed as currently unreasonable because no successful drug therapy had yet taken place.
This does not mean that people suffering from addiction should never receive instructions on abstinence. But it means: the specific life situation, ability to treat, ability to control and previous treatment play a role. Especially in the case of addiction, it should therefore be clarified early on whether therapy, substitution, addiction counseling or an inpatient measure makes more legal and medical sense than pure control.
Therapy instead of punishment: Not automatic, but important
In certain situations, § 35 BtMG and § 36 BtMG can play a role in drug addiction. Colloquially, this is often called “therapy instead of punishment”. Whether this is possible depends on the specific procedure, the punishment, the dependency, the willingness to undergo therapy and other requirements.

What to do if a test is positive or there is a risk of revocation?
Now what counts is speed and clean documentation. Those affected should not ignore appointments and should not make spontaneous statements that will later cause harm. An orderly approach makes sense:
- Secure the probation decision and test request completely.
- Request or copy the test result, laboratory report and time of sample.
- No manipulation, no excuses, no further missed appointments.
- Immediately contact addiction counseling, a doctor or therapy offer if a relapse occurs.
- If there is a hearing, a request for revocation or if the legal situation is unclear, seek legal advice.
- If costs are the problem: submit a written application immediately and attach financial evidence.
